Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

If you wish to “Purchase” any product or service made available through the Service, you may be asked to supply certain information relevant to your “Purchase” including, without limitation, your credit card details and personal Information which it's use can be viewed in our "Privacy Policy".

Subscriptions

Some parts of the Service are billed on a subscription basis "Subscription". You will be billed in advance on a recurring monthly basis. Read also below "Trial Period"

Trial Period

For some Trials, we’ll require you to provide your payment details to start the Trial. at the end of such trials, we may automatically start to charge you for the applicable paid subscription on the first day following the end of the trial, on a recurring monthly basis. By providing your payment details in conjunction with the trial, you agree to this charge using such payment details. If you do not want this charge, you must cancel the applicable paid subscription through your duskmusic account’s subscription page or terminate your duskmusic account before the end of the trial. If you do not want to continue to be charged on a recurring monthly basis, you must cancel the applicable paid subscription through your Duskmusic account’s subscription page or terminate your duskmusic account before the end of the recurring monthly period. Paid subscriptions cannot be terminated before the end of the period for which you have already paid, and except as expressly provided in these terms, duskmusic will not refund any fees that you have already paid. 

Royalty Free Playlists:

"Royalty free" are deemed music playlists that are featured on duskmusic.com (clearly labeled as Royalty Free) that are exempt from any music licensing boards in the world. (In Australia this is APRA/PPCA but pls check in your region for applicable organisations).  

APRA & PPCA Fee's

Business's streaming our other playlists/content will need to contact both APRA ad PPCA directly to obtain their licenses for playing our content. We are happy to provide advise but note that "We Are Dusk" Pty Ltd expressly disclaims all liability for, damages of any kind, arising out of any use, reference, reliance on any information given. 

General

The information contained in this website is for general information purposes only. The information is provided by “We Are Dusk” Pty Ltd and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Through this website you are able to link to other websites which are not under the control of “We Are Dusk” Pty Ltd. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the website up and running smoothly. However, “We Are Dusk” Pty Ltd takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.
